1. Introduction

These Terms and Conditions govern your use of the Aussie Creatives Studio website and the services provided by Aussie Creatives Studio.

By accessing our website, requesting a quote, making a payment, approving a proposal, or engaging our services, you agree to be bound by these Terms and Conditions.

If you do not agree with these Terms, please do not use our website or engage our services.

2. Services

Aussie Creatives Studio provides digital services including, but not limited to:

  • Website design
  • Website development
  • Mobile app development
  • Branding
  • SEO
  • PPC advertising
  • Shopify and eCommerce solutions
  • Digital marketing
  • AI solutions
  • UX auditing
  • Business automation and digital systems

The specific scope, timeline, pricing, inclusions, and deliverables for each project will be agreed separately through a written proposal, invoice, package description, quotation, contract, or approved written communication.

Any service, feature, page, design, integration, or functionality not included in the agreed scope will be treated as additional work and may require a separate quote and payment.

3. Project Initiation

A project is considered officially started only after the client has submitted both:

  • Screenshot or proof of payment; and
  • Completed requirement form, project brief, or required project details to the Aussie Creatives Studio sales team.

Delivery timelines do not begin until both items have been received.

Clients are responsible for providing accurate, complete, and clear project information. Missing details, incomplete forms, delayed feedback, unclear instructions, missing content, or late submission of required information may delay the project timeline.

To start the project, the client must share the payment screenshot and completed requirement form with the Aussie Creatives Studio sales team.

4. Payment Terms

A deposit is required before work begins unless otherwise agreed in writing.

The deposit amount may vary depending on the selected package, project type, quotation, or agreed payment arrangement.

Invoices are due within the timeframe stated on the invoice or written agreement. If no timeframe is stated, invoices are due within 14 days of issue.

Aussie Creatives Studio may pause work, delay delivery, withhold files, or suspend services if payments are overdue.

Ownership of final deliverables transfers to the client only after full payment has been received. Until full payment is made, all designs, website files, concepts, layouts, development work, written content, and other project deliverables remain the property of Aussie Creatives Studio.

5. Refund Policy

Aussie Creatives Studio offers a 30-day refund guarantee for the initial website design or website development deposit only.

This refund guarantee applies only where there is genuine service non-delivery or reasonable dissatisfaction with the initial website design or website development work before approval.

The refund guarantee applies only to the initial deposit paid for website design or website development. It does not apply to SEO, hosting, domain registration, third-party tools, paid plugins, software licences, integrations, additional work, or any service outside the original website design or development scope.

A refund request must be submitted in writing within 30 days from the project initiation date. For the purpose of this policy, the project initiation date is the date when the client has submitted both the payment screenshot and the completed requirement form to the sales team. Refund requests submitted after the 30-day period may not be accepted, except where required under applicable law.

6. Design Approval and Refund Window

Once the client reviews the initial website design or development work and confirms that the design, layout, direction, or work is acceptable, the work will be considered approved. Approval may be given verbally, in writing, by email, message, project management platform, or any other communication channel used between the client and Aussie Creatives Studio.

Examples of approval include, but are not limited to:

  • "The design looks good"
  • "Yes, please continue"
  • "Please add this"
  • "Please make these changes"
  • "Move forward with this design"
  • "I approve this layout"
  • "This is fine, just update this section"
  • "Looks good, please proceed"

If the client says the design is good and then requests additions, edits, changes, revisions, or further development, this will be treated as approval of the initial work. Once approval is given, the refund window for the initial website deposit closes. After approval, any further changes will be treated as revisions, scope changes, or additional paid work depending on the agreed scope and the nature of the request.

7. Non-Refundable Services and Payments

The 30-day refund guarantee applies only to the initial website design or website development deposit. The following payments are non-refundable to the extent permitted by law:

  • SEO services
  • Hosting payments
  • Domain registration
  • Paid plugins
  • Paid themes
  • Software licences
  • Third-party tools
  • Third-party subscriptions
  • App or platform fees
  • Payment gateway setup
  • CRM setup
  • Booking system setup
  • Email marketing setup
  • Additional website pages
  • Additional website sections
  • Additional website features
  • Additional design changes outside the agreed scope
  • Copywriting
  • Branding
  • PPC advertising
  • Marketing services
  • Approved work
  • Completed work
  • Delivered work
  • Work already started after client approval

These services and payments are non-refundable because they may involve purchases, setup, configuration, vendor payments, external resources, software licences, third-party costs, or work completed according to the client's specific requirements. Once a service has been purchased, configured, activated, assigned, delivered, or rendered, it cannot be refunded because the cost has already been paid to vendors, platforms, contractors, software providers, or internal resources. Services once rendered are generally non-refundable, except where a refund, remedy, repair, replacement, or resupply is required under Australian Consumer Law.

8. When a Refund May Be Considered

A refund may be considered where:

  • Aussie Creatives Studio does not start or deliver the agreed initial website design or development service;
  • The initial delivered work is materially different from the agreed scope;
  • The client raises reasonable dissatisfaction before approving the work; or
  • Aussie Creatives Studio is given a fair opportunity to resolve the issue but does not provide a reasonable solution.

A refund will generally not apply where:

  • The client changes their mind after approving the work;
  • The client has already approved the design, layout, direction, or development stage;
  • The client delays the project by not providing content, feedback, login details, access, or required information;
  • The client requests work outside the original scope;
  • The client requests additional changes after approval;
  • The service has been delivered according to the agreed project requirements;
  • The request relates to SEO, hosting, domains, plugins, licences, software, third-party fees, integrations, or additional paid work;
  • The service has already been purchased, configured, activated, delivered, or rendered; or
  • The client no longer wants to continue for reasons unrelated to Aussie Creatives Studio's delivery.

Aussie Creatives Studio may, at its discretion, offer revisions, corrections, partial remedies, or other reasonable solutions before considering a refund. Nothing in this refund policy limits any rights the client may have under Australian Consumer Law.

9. Australian Consumer Law

Nothing in these Terms and Conditions excludes, restricts, or modifies any rights, remedies, guarantees, warranties, or protections that cannot be excluded under Australian Consumer Law. These Terms are intended to operate fairly and reasonably and will not apply to the extent that any term is found to be unfair, void, unlawful, or unenforceable under applicable Australian law.

Where services are supplied to a consumer under Australian Consumer Law, those services come with guarantees that cannot be excluded. If a service failure qualifies under applicable law, the client may be entitled to a remedy as required by law. These Terms apply to the extent permitted by Australian law.

10. Client Responsibilities

The client agrees to:

  • Provide accurate and complete project information;
  • Submit the requirement form or project brief on time;
  • Provide content, images, branding, login details, and access where required;
  • Review work and provide feedback within a reasonable timeframe;
  • Ensure all materials supplied to Aussie Creatives Studio are legally owned by the client or authorised for use;
  • Ensure supplied content does not infringe third-party rights;
  • Respond to requests for clarification in a timely manner;
  • Notify Aussie Creatives Studio promptly of any required changes; and
  • Make payments on time according to the agreed terms.

Aussie Creatives Studio is not responsible for delays caused by missing content, late feedback, incomplete requirements, incorrect information, lack of access, third-party delays, or client-side decision delays. If the client delays the project, the project timeline will be extended accordingly.

11. Revisions and Changes

Each project includes the revision rounds stated in the proposal, invoice, package, or written agreement. Revisions are limited to reasonable changes within the original agreed scope. A revision means improving, adjusting, or refining work that has already been agreed. It does not mean adding a new page, new feature, new design direction, new functionality, or a different project concept.

Additional revisions or changes outside the agreed scope will be quoted and billed separately. Examples of additional work may include:

  • Extra website pages
  • Extra website sections
  • New design concepts
  • New functionality
  • Booking systems
  • Payment systems
  • Advanced forms
  • CRM integrations
  • SEO setup
  • Copywriting
  • Hosting setup
  • Domain setup
  • Plugin or software configuration
  • App or portal functionality
  • Major redesign requests after approval

Once the client approves a design, layout, page, section, feature, or development stage, that stage is considered accepted. Further changes after approval may be treated as additional work and may affect the project cost and timeline.

12. Business Hours and Communication

Aussie Creatives Studio carries out project work during business days and business hours. All delivery timelines, response times, revision times, and estimated 24-48 hour timeframes apply only during business days and business hours. Weekends, public holidays, after-hours periods, and client-side delays are not counted within these timeframes.

Communication will be handled during business hours through the assigned point of contact, sales team, or project team. An Aussie Creatives Studio representative may contact the client outside business hours only where urgent clarification is required. Aussie Creatives Studio discourages regular after-hours work, calls, revisions, or communication unless separately agreed in writing.

13. Delivery Timelines

Project timelines are estimates unless a fixed delivery date has been agreed in writing. Delivery timelines may be affected by:

  • Late client responses
  • Incomplete requirement forms
  • Missing content
  • Missing images or branding assets
  • Delayed login details or platform access
  • Third-party provider delays
  • Additional work requests
  • Change in project scope
  • Delayed approvals
  • Late payments
  • Technical issues beyond Aussie Creatives Studio's control

If the client causes a delay, the project timeline will be extended accordingly. Aussie Creatives Studio is not responsible for missed deadlines caused by client-side delays or third-party issues.

14. Third-Party Services

Some projects may require third-party products or services, including but not limited to:

  • Domain providers
  • Hosting providers
  • WordPress themes
  • Plugins
  • Shopify apps
  • Payment gateways
  • Booking systems
  • CRM platforms
  • Email marketing tools
  • Analytics tools
  • Software licences
  • APIs
  • Stock images
  • Fonts
  • External integrations

The client is responsible for any third-party fees unless otherwise agreed in writing. Aussie Creatives Studio is not responsible for changes, outages, errors, limitations, price increases, policy changes, suspension, or cancellation of third-party services. Third-party costs are non-refundable once purchased, activated, configured, connected, or assigned to the client's project.

15. Website Hosting, Domains and Ongoing Services

Hosting, domain registration, maintenance, SEO, marketing, and other ongoing services may be billed separately from website design or development. Unless otherwise agreed in writing, hosting and domain services are third-party or ongoing service costs and are non-refundable once activated or paid.

If the client fails to renew hosting, domain, software, plugin, or maintenance services, the website or related services may stop working. Aussie Creatives Studio is not responsible for service interruption caused by unpaid renewals, expired domains, expired licences, hosting issues, plugin issues, or third-party provider action.

16. SEO and Marketing Services

SEO, PPC, social media, and digital marketing services are based on strategy, implementation, optimisation, and ongoing improvement. Aussie Creatives Studio does not guarantee specific rankings, traffic, leads, sales, conversions, or revenue outcomes from SEO, PPC, or marketing services. Search engine rankings and advertising results may be affected by many external factors, including competition, search engine algorithm updates, website history, budget, market demand, content quality, backlinks, technical issues, and user behaviour.

Payments made for SEO, PPC, marketing, or advertising services are non-refundable once work has started, been configured, been delivered, or services have been rendered, except where required by law.

17. Intellectual Property

Upon full payment, the client receives ownership of the final approved deliverables created specifically for their project. This may include final website files, approved designs, written content, graphics, or other agreed project assets.

Aussie Creatives Studio retains ownership of pre-existing tools, frameworks, templates, systems, processes, internal methods, reusable code, proprietary components, draft concepts not selected or approved, and unused designs or creative work. The client may not claim ownership of Aussie Creatives Studio's pre-existing tools, systems, templates, or proprietary materials unless expressly agreed in writing.

Aussie Creatives Studio reserves the right to display completed work in its portfolio, case studies, social media, marketing materials, or website unless the client requests otherwise in writing.

18. Client Content and Materials

The client is responsible for ensuring that all content, images, logos, videos, text, branding assets, product information, and other materials provided to Aussie Creatives Studio are accurate, lawful, and authorised for use. The client confirms that they either own the materials provided or have permission to use them.

Aussie Creatives Studio is not responsible for copyright claims, trademark claims, licensing issues, incorrect information, misleading claims, or legal issues arising from client-supplied materials.

19. Website Content and Compliance

The client is responsible for reviewing and approving all website content before publication. Aussie Creatives Studio may assist with content writing, editing, formatting, or placement, but the client remains responsible for ensuring that all published information is accurate, lawful, compliant, and suitable for their business or industry. This includes, but is not limited to:

  • Service claims
  • Product claims
  • Health-related claims
  • Finance-related claims
  • Legal claims
  • Pricing
  • Business descriptions
  • Policies
  • Terms
  • Disclaimers
  • Regulatory information

Aussie Creatives Studio is not responsible for legal, regulatory, industry-specific, or compliance consequences resulting from client-approved content.

20. Website Maintenance and Post-Delivery Support

Once a website or project is delivered, any further support, maintenance, updates, edits, fixes, backups, monitoring, plugin updates, security updates, or technical support may require a separate maintenance plan or paid service. Unless included in the written agreement, ongoing maintenance is not included in the original website design or development fee.

Aussie Creatives Studio is not responsible for future issues caused by:

  • Third-party plugin updates
  • Theme updates
  • Hosting issues
  • Malware or security breaches
  • Client edits
  • Third-party developer changes
  • Expired licences
  • Outdated software
  • External platform changes
  • Unpaid maintenance or hosting services

21. Suspension or Pause of Work

Aussie Creatives Studio may pause or suspend work if:

  • Payment is overdue;
  • Required information is missing;
  • Client feedback is delayed;
  • Project access is not provided;
  • The scope is unclear;
  • The client requests major changes without approving additional cost;
  • Communication becomes unreasonable, abusive, or unprofessional; or
  • Third-party tools or services required for the project are unavailable.

If a project is paused due to client delay, the original timeline may no longer apply.

22. Termination

Either party may terminate a project by providing written notice. If the client terminates the project after work has started, the client remains responsible for payment for all work completed, time spent, third-party costs incurred, vendor payments made, resources allocated, and approved deliverables up to the termination date. Deposits and payments may be non-refundable where work has already started, been approved, been delivered, been configured, been rendered, or where costs have already been incurred, subject to applicable law.

Aussie Creatives Studio may terminate or refuse service where the client breaches these Terms, fails to make payment, acts unlawfully, provides misleading information, or engages in abusive, threatening, or unreasonable conduct.

23. Limitation of Liability

To the fullest extent permitted by law, Aussie Creatives Studio's total liability for any claim arising from its services is limited to the total amount paid by the client for the specific service giving rise to the claim. Aussie Creatives Studio is not liable for indirect, incidental, special, consequential, or loss-of-profit damages, including but not limited to:

  • Lost revenue
  • Lost leads
  • Lost sales
  • Loss of business opportunity
  • Loss of data
  • Loss of rankings
  • Website downtime
  • Third-party platform issues
  • Advertising performance
  • Search engine changes
  • Hosting provider failures
  • Plugin or software conflicts

This limitation applies to the extent permitted by Australian law. Nothing in this clause limits, excludes, or modifies any consumer guarantee, remedy, right, or protection that cannot legally be limited, excluded, or modified under Australian Consumer Law.

24. No Guarantee of Business Results

Aussie Creatives Studio aims to provide professional digital services with care and skill. However, Aussie Creatives Studio does not guarantee that a website, SEO campaign, advertisement, design, app, or digital system will produce a specific business result. This includes, but is not limited to:

  • First-page Google rankings
  • Specific keyword positions
  • Fixed traffic numbers
  • Guaranteed leads
  • Guaranteed sales
  • Guaranteed conversion rates
  • Guaranteed app downloads
  • Guaranteed revenue growth

Business outcomes depend on multiple factors outside Aussie Creatives Studio's control.

25. Confidentiality

Both parties agree to keep confidential information private and not disclose it to third parties unless required for project delivery, required by law, or agreed in writing. Confidential information may include business information, login details, project documents, pricing, strategies, customer data, technical information, and internal communications.

26. Privacy

Aussie Creatives Studio may collect and use client information for communication, project delivery, invoicing, support, marketing, and business administration. Clients must not provide sensitive personal information, customer data, or third-party information unless they have the right to do so. For more information about how Aussie Creatives Studio collects, uses, stores, and protects personal information, please refer to our Privacy Policy.

27. Website Use

Users of the Aussie Creatives Studio website agree not to:

  • Misuse the website;
  • Attempt to hack, damage, or disrupt the website;
  • Copy website content without permission;
  • Submit false or misleading information;
  • Use the website for unlawful purposes; or
  • Interfere with website security or functionality.

Aussie Creatives Studio reserves the right to restrict access to the website where misuse is suspected.

28. Changes to These Terms

Aussie Creatives Studio may update these Terms and Conditions from time to time. The updated version will be published on the Aussie Creatives Studio website with the latest revision date. Updated Terms will apply to future website use, future enquiries, future quotations, future invoices, and future services.

For existing active projects, the Terms that applied at the time of engagement will generally continue to apply unless both parties agree otherwise in writing, except where changes are required by law.

29. Governing Law

These Terms and Conditions are governed by the laws of Victoria, Australia. Any disputes will be subject to the non-exclusive jurisdiction of the courts of Victoria, Australia.
